A federal judge has paused his order that disqualified the acting U.S. attorney for Nevada from overseeing several criminal cases.
The acting U.S. attorney, Sigal Chattah, was initially appointed by President Donald Trump as Nevada's interim U.S. attorney and was later reclassified as the "acting" U.S. attorney, bypassing the Senate confirmation process.
Federal public defenders in four criminal cases filed motions arguing that this workaround violates the Federal Vacancies Reform Act, and Judge Campbell sided with them in an order issued last month.
However, on Thursday, Judge Campbell granted the government's motion to stay his ruling against Chattah's appointment pending an appeal to the Ninth Circuit.
